These Terms of Service ("Terms") are a legal agreement between you and BarnKeeper LLC, a Connecticut limited liability company ("BarnKeeper," "we," "us," or "our"). They govern your use of the BarnKeeper mobile application, the website at barnkeeper.co, and any related services (together, the "Services").

By creating an account, downloading the app, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Please also read our Privacy Policy, which explains how we handle your information. It is incorporated into these Terms by reference.

Summary of key points

BarnKeeper is a record keeping tool for horse care. It is not a veterinarian, and its recommendations are general information rather than advice about your animal. You own your records and can delete them at any time. Subscriptions are billed by Apple, and you cancel them in your Apple Account settings.

Is BarnKeeper veterinary advice? No. Blanketing recommendations and any health related information are general reference only. Always consult a licensed veterinarian about your animal. See section 7.

Who owns the records I enter? You do. We store them to run the Services for you and the people you invite to your barn. See section 6.

How does billing work? Subscriptions are sold and billed by Apple through the App Store. They renew automatically until you cancel. See section 4.

What happens if I invite someone to my barn? They can see the horses and care records in that barn according to the role you assign them. See section 5.

Can I stop using BarnKeeper? Yes. You can delete your account from within the app at any time, and cancel your subscription through Apple. See sections 3 and 13.

1. Who can use BarnKeeper

In short: You must be at least 13, and under 18 you need a parent or guardian's permission.

You must be at least 13 years old, or the equivalent minimum age in your jurisdiction, to use the Services.

If you are under 18, or under the age of majority where you live, you may use the Services only with the permission and supervision of a parent or legal guardian who agrees to these Terms on your behalf and accepts responsibility for your use of the Services.

If you are creating an account on behalf of a business, farm, or other organization, you represent that you have authority to bind that organization to these Terms.

2. Your account

In short: Keep your login details secure. You can delete your account from within the app at any time.

You need an account to use most of BarnKeeper. When you create one, you agree to provide accurate information and to keep it current.

You are responsible for keeping your login credentials confidential and for everything that happens under your account. If you believe someone has gained unauthorized access to your account, please contact us at support@barnkeeper.co promptly.

You may delete your account at any time from within the app, under Settings. Deleting your account removes your data as described in our Privacy Policy. Deleting your account does not by itself cancel a subscription purchased through Apple. See section 3.

3. Subscriptions and billing

In short: Apple sells and bills all subscriptions. They renew automatically until you cancel in your Apple Account settings.

BarnKeeper offers paid subscription plans. Plan names, features, prices, and billing periods are shown in the app before you purchase, and they may change over time.

All subscriptions are sold and billed by Apple through the App Store. We do not collect, process, or store your payment card details. Your purchase is also governed by Apple's terms.

Automatic renewal. Subscriptions renew automatically at the end of each billing period at the then-current price, unless you cancel at least 24 hours before the period ends. Your Apple Account is charged for renewal within 24 hours before the current period ends.

Cancellation. You can cancel at any time in your Apple Account subscription settings on your device. Cancellation takes effect at the end of the current billing period, and you keep access to paid features until then.

Refunds. Because Apple handles billing, refunds are handled by Apple under its own policies. We cannot issue refunds directly for App Store purchases. You can request one through Apple's support site.

Price changes. If we change the price of a subscription, Apple will notify you and, where required, ask for your consent before the new price takes effect. If you do not agree, you can cancel before your next renewal.

Plan limits. Plans may include limits, such as the number of horses you can track. If you exceed the limit of your plan, some features may become unavailable until you upgrade or reduce your usage. We will not delete your records because you exceeded a plan limit.

If your trial or subscription ends. When a free trial ends and no subscription is purchased, your barn becomes an archive: every record you have entered stays readable for as long as your account exists, and BarnKeeper stops accepting new entries until you subscribe. There is no deadline after which the app closes. We do not delete your records, you can export them or delete your account at any time, and subscribing later picks up exactly where you left off.

4. Free trials and offers

In short: A free trial becomes a paid subscription automatically unless you cancel before it ends.

We may offer free trials, promotional pricing, or offer codes. The terms of any such offer are shown at the time it is presented. Unless stated otherwise, a free trial converts to a paid subscription automatically at the end of the trial period unless you cancel before it ends.

New accounts receive a free trial from us when they sign up. Separately, Apple may offer an introductory free trial on a subscription; eligibility for Apple's offers is set and enforced by Apple. We may change or end promotional offers at any time for future purchases. Doing so will not affect an offer you have already redeemed.

5. Barns, invited people, and shared access

In short: People you invite to your barn can see the horses and care records in it, based on the role you give them.

BarnKeeper lets you create a barn and invite other people to it, assigning each person a role that determines what they can see and do.

You should understand what this means before you invite anyone. People you invite to your barn will be able to see information about the horses in that barn, including health records, medications, and care history, according to the role you assign them. You control who is invited and what role they hold, and you are responsible for choosing roles appropriately.

If you invite someone, you confirm that you have the right to share the information they will be able to see. If a horse in your barn belongs to someone else, it is your responsibility to have that owner's permission.

You can remove someone from your barn at any time, which ends their access going forward. We cannot retrieve or unshare information that someone has already viewed, copied, or exported.

6. Your content and records

In short: You own what you enter. Keep your own copies of anything you cannot afford to lose.

You keep ownership of everything you put into BarnKeeper: horse profiles, health and veterinary records, photos, notes, expenses, and anything else you enter.

You can export a complete copy of your records at any time from within the app, under Settings. The export includes your photos and uploaded documents as files, not merely as links, so it remains usable after you delete your account.

You give us a limited license to store, copy, transmit, and display your content solely for the purpose of operating the Services for you and the people you have invited to your barn. This license ends when you delete the content or your account, except for copies retained in backups for a limited period, or where we are required to keep records by law.

Some documents you upload may contain information about other people, such as a seller, a previous owner, or a veterinarian. You are responsible for having the right to upload and share them.

You are responsible for the accuracy of the records you enter. You are also responsible for keeping your own copies of anything you cannot afford to lose. While we take reasonable steps to protect your data, no service is immune to loss, and BarnKeeper should not be your only record of anything critical to your animals' care.

7. BarnKeeper is not veterinary advice

In short: BarnKeeper is a record keeping tool, not a veterinarian. Always consult a licensed veterinarian about your animal's health.

BarnKeeper is a record keeping and organizational tool. It is not a veterinarian, a veterinary service, or a substitute for professional judgment about an animal.

Some features generate suggestions from general information and third party data. Blanketing recommendations, for example, are produced from weather forecast data and the details you enter. They are not based on an examination of your horse, and they do not account for the many factors a veterinarian or an experienced caretaker would consider, including body condition, age, coat, health status, shelter, and the conditions in your specific barn or field.

Any information in the Services relating to medications, dosages, feeding, health conditions, blanketing, turnout, or care is provided for general reference only. Always consult a licensed veterinarian before starting, changing, or stopping any medication or treatment, and whenever you have any concern about an animal's health or welfare. In an emergency, contact your veterinarian immediately rather than relying on the app.

You are solely responsible for the care, health, and welfare of your animals and for every decision you make about them. You agree not to rely on the Services as your sole basis for any care decision.

8. Acceptable use

In short: Use BarnKeeper lawfully, and do not attempt to break, copy, or resell it.

You agree not to:

Use the Services for any unlawful purpose, or in violation of any law that applies to you, including laws about animal welfare and veterinary practice
Access another person's account, or attempt to gain access to any part of the Services you have not been granted
Interfere with, disrupt, overload, or attempt to probe the security of the Services or their infrastructure
Reverse engineer, decompile, or attempt to extract the source code of the app, except where that restriction is prohibited by law
Use automated means to access, scrape, or copy the Services
Upload anything unlawful, or anything containing malware
Harass, threaten, or abuse other members of a barn, or send them unlawful or deliberately harmful content
Resell, sublicense, or commercially redistribute access to the Services
Use the Services to provide veterinary services or advice to third parties in a way that presents our output as professional advice

If someone in a barn sends you a message that breaks these rules, you can remove them from the barn if you are its owner or an admin, and you can report it to us at support@barnkeeper.co. We review reports of abusive content and may remove content or suspend accounts under section 13.

9. Beta and pre-release versions

In short: Beta builds are for testing, come with no warranty, and expire.

We may make beta, preview, or pre-release versions of BarnKeeper available, including through Apple TestFlight. These versions are provided for testing and are more likely than released versions to contain defects, lose data, or behave unexpectedly.

Beta versions are provided as is, without any warranty, and may be changed or withdrawn at any time. Builds distributed through TestFlight expire and stop working after a period set by Apple. Do not rely on a beta version as your only record of anything important, and keep your own copies of critical information while testing.

10. Availability and changes

In short: We aim to keep the Services running, but we cannot promise they will never be unavailable.

We aim to keep the Services running, but we do not promise they will be uninterrupted or error free. The Services depend on third party infrastructure, including Apple, Google, and weather data providers, and may be unavailable because of maintenance, outages, or events outside our control.

We may add, change, or remove features over time. If we make a change that materially reduces the core functionality of a paid plan, we will give you notice and, where appropriate, a way to cancel.

The Services require an internet connection for some features. Weather based features depend on data from third party providers and on the barn location you enter in Settings, which is a town and state or a postal code. BarnKeeper does not use your device's location.

11. Our intellectual property

In short: We own BarnKeeper. You get a personal license to use it.

The Services, including the BarnKeeper software, design, text, graphics, and the BarnKeeper name and logo, are owned by BarnKeeper LLC and protected by intellectual property law. Nothing in these Terms transfers any of those rights to you.

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the app on Apple devices you own or control, for your own horse care purposes.

12. Feedback

We welcome feedback, bug reports, and feature suggestions. If you send them to us, you agree we may use them without restriction and without any obligation to compensate you. This does not give us any rights in your records or other content.

13. Ending your use of BarnKeeper

In short: You can leave at any time. We can end access if you materially breach these Terms.

You may stop using the Services at any time, and delete your account from within the app.

We may suspend or terminate your access if you materially breach these Terms, if we are required to by law, or if we discontinue the Services. Except where a breach makes it impractical, we will make reasonable efforts to give you notice and an opportunity to export or retrieve your records first.

Sections that by their nature should survive termination will survive, including sections 6, 7, 11, 12, 14, 15, 16, and 18.

14. Disclaimer of warranties

To the fullest extent permitted by law, the Services are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. We specifically disclaim any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Services will meet your requirements, be uninterrupted, secure, or error free, that any defect will be corrected, or that any information provided through the Services, including weather data and any recommendation derived from it, is accurate, complete, or suitable for your animals.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

15. Limitation of liability

To the fullest extent permitted by law, BarnKeeper LLC and its members, officers, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of or inability to use the Services, however caused and under any theory of liability.

Without limiting the above, we are not liable for any injury, illness, loss, or death of any animal, or for any veterinary or other costs, arising from your use of the Services or from any decision you made in reliance on information in the Services.

Our total aggregate liability for all claims relating to the Services will not exceed the greater of the amount you paid us for the Services in the twelve months before the event giving rise to the claim, or fifty United States dollars.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

16. Indemnification

You agree to indemnify and hold harmless BarnKeeper LLC and its members, officers, and agents from any claims, damages, losses, and reasonable legal fees arising out of your use of the Services, your content, your violation of these Terms, or your violation of the rights of any third party, including any person you invite to your barn.

17. Apple App Store terms

In short: Your agreement is with us, not Apple. Support requests come to us.

The following applies because you obtained the app from the Apple App Store:

These Terms are between you and BarnKeeper LLC only, not with Apple. Apple is not responsible for the app or its content.
Apple has no obligation to provide any maintenance or support for the app. Support requests should go to support@barnkeeper.co.
If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
Apple is not responsible for addressing any claim by you or a third party relating to the app, including product liability claims, claims that the app fails to conform to a legal requirement, and claims under consumer protection or similar law.
Apple is not responsible for investigating, defending, settling, or discharging any third party claim that the app infringes intellectual property rights.
You represent that you are not located in a country subject to a United States Government embargo or designated as a terrorist supporting country, and that you are not on any United States Government list of prohibited or restricted parties.
Apple and its subsidiaries are third party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce them against you.

18. Governing law and disputes

These Terms are governed by the laws of the State of Connecticut, without regard to its conflict of law rules.

If a dispute arises, we would rather solve it directly. Please email support@barnkeeper.co first and give us a reasonable opportunity to resolve it.

If we cannot resolve it informally, you and BarnKeeper LLC agree that any dispute will be brought exclusively in the state or federal courts located in Connecticut, and you consent to the jurisdiction of those courts. Nothing here prevents either party from seeking injunctive relief where appropriate, and nothing here limits any right you have to bring a claim in small claims court.

19. Do we make updates to these terms?

In short: Yes. We will give you at least 30 days' notice of material changes.

We may update these Terms from time to time. The updated version will be indicated by an updated "Last updated" date at the top of these Terms.

If we make material changes, we will give you at least 30 days' notice before they take effect, by posting a notice in the app, on this page, or by email. Your continued use of the Services after the changes take effect means you accept the updated Terms. If you do not accept them, stop using the Services and cancel any subscription before the changes take effect.
